Terms of Service

Effective Date: 11 February 2025

These Terms of Service ("Terms") govern your use of BookBeam ("we", "us", "our"), accessible at bookbeam.app. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use BookBeam.

1. Service Description

BookBeam is a book distribution platform for authors. The service allows you to:

  • Upload eBook files (EPUB, MOBI, PDF) and cover images
  • Create shareable signup links for readers to download your books
  • Collect reader email addresses and track download activity
  • Export reader data as CSV
  • Configure webhook integrations to send reader data to third-party newsletter services
  • Manage book projects within team workspaces

2. Account Eligibility and Registration

You must be at least 18 years old to create an account. You must provide accurate information during registration (name, email address, password). You are responsible for maintaining the security of your account credentials, including any two-factor authentication secrets and API tokens.

Each account is associated with a personal team. You may create additional teams and invite other users to collaborate.

3. Content Ownership and Distribution Rights

You retain full ownership of all content you upload to BookBeam, including book files, cover images, and metadata. By uploading content, you grant BookBeam a limited, non-exclusive licence to store, serve, and distribute that content solely for the purpose of operating the service on your behalf.

You represent and warrant that:

  • You own or hold valid licences to all content you upload
  • Your content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights
  • You have the legal right to distribute the content through BookBeam

BookBeam does not review or moderate uploaded content. You are solely responsible for the legality of the content you distribute.

4. Acceptable Use

You agree not to:

  • Upload content you do not have the right to distribute
  • Use reader email addresses for unsolicited communications (spam) or sell reader contact lists
  • Distribute malware, viruses, or harmful files through the service
  • Attempt to gain unauthorised access to other users' accounts, data, or book projects
  • Circumvent rate limits, security measures, or access controls
  • Use the service to violate any applicable law or regulation
  • Use automated tools to scrape data or abuse the platform

5. Reader Data Responsibilities

When readers provide their email addresses to download your books, you are the data controller for those email addresses. BookBeam acts as a data processor on your behalf.

You must:

  • Comply with GDPR, CAN-SPAM, and all other applicable data protection and privacy laws
  • Only use reader data for purposes readers would reasonably expect (e.g. sending them relevant book updates)
  • Not sell, rent, or otherwise commercially exploit reader email lists
  • Honour reader requests to access, correct, or delete their personal data
  • Ensure any third-party newsletter service you connect via webhook also complies with applicable privacy laws

Webhook integrations: When you configure a newsletter webhook URL, BookBeam will send reader email addresses, book title, author name, and signup timestamps to that URL each time a reader signs up. You are solely responsible for the security and privacy compliance of the receiving service.

6. Payment Terms

BookBeam offers both one-time lifetime deals and recurring subscription plans. All payments are processed by LemonSqueezy, our third-party payment processor. BookBeam does not store your credit card details.

  • Lifetime deals grant perpetual access to the service as it exists at the time of purchase
  • Subscriptions renew automatically (monthly or annually) until cancelled
  • You may manage your subscription, update payment methods, or cancel through the LemonSqueezy customer portal accessible from your billing page
  • Refunds are handled in accordance with LemonSqueezy's policies
  • Access to paid features is gated at the team level: the subscribing team's members all gain access

7. API Tokens

You may generate personal API tokens through your account settings. You are responsible for keeping these tokens secure. Treat API tokens as you would a password. BookBeam is not liable for any unauthorised access resulting from compromised API tokens.

8. Teams

Team owners are responsible for the actions of their team members on the platform. When a team owner deletes a team, all associated book projects, files, signup links, and download records are permanently deleted.

9. Intellectual Property

BookBeam's name, logo, design, and underlying software are the intellectual property of BookBeam. You may not copy, modify, or reverse-engineer any part of the service. Nothing in these Terms transfers any BookBeam intellectual property to you.

10. Account Termination

By you: You may delete your account at any time from your profile settings. This will permanently delete your user data, teams you own, and all associated book projects and files.

By us: We reserve the right to suspend or terminate your account if you violate these Terms. We will make reasonable efforts to notify you before termination, except in cases of serious or repeated violations.

Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Service Availability

BookBeam is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to provide advance notice of significant changes.

12. Limitation of Liability

To the maximum extent permitted by law, BookBeam and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of or inability to use the service.

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to BookBeam in the twelve months preceding the claim.

13. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be secure, error-free, or that any defects will be corrected.

14. Indemnification

You agree to indemnify and hold harmless BookBeam, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Content you upload or distribute
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights

15. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the service. Your continued use of BookBeam after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
